By using the Site, you agree on behalf of yourself and any organization that you represent (together, “you”) that you have read and understand this Policy. We may modify this Policy at any time. All changes will be effective immediately upon posting to the Site. Material changes will be conspicuously posted on the Site or otherwise communicated to you. By using the Site after changes are posted, you agree to those changes.
We Collect Data You Provide
Personal Data. You can visit the Site without providing data that personally identifies you. If you elect to provide data that is identifiable to you as an individual (“Personal Data”) personally identifies you, such as your name, email and mailing address, phone number, driver’s license number, payment data, or tax identification number, we will collect and use it pursuant to this Policy and applicable law.
Personal Data is required to use certain Site features, for example, to book a party, contact us via email or our Contact Us form (where we may retain the content of your message and our response), submit job application materials, receive or request data from us, and respond to communications from us (e.g., surveys and promotional offers).
Order & Payment Data. To make purchases through the Site, you must submit your name, credit or debit card type, number, expiration date, security code, and billing address. All credit and debit card data is provided directly to our PCI-compliant third-party payment processor. We do not directly access, handle, or store your credit or debit card data. We may maintain a record of your purchases through the Site. We store your payment card’s last four digits to facilitate future orders. We collect tax identification numbers if you submit one for tax-exempt purposes.
Marketing Communications; Blog. If you opt in to receive marketing communications from us (e.g., our mailing list or updates to our blog), you must submit your name, email address and phone number. We use this data to provide you with promotional and other electronic and hard copy communications. We may use third-party providers to deliver communications to you. You may opt out of receiving email marketing communications by using the unsubscribe link in the applicable email or contacting us at firstname.lastname@example.org with “Unsubscribe” in the subject line. You can opt out of SMS text messaging communications by texting “STOP” in response to the text message you received. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from that particular number. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again. To opt out of other forms of marketing, such as postal marketing or telemarketing, please contact us. Opting out of marketing communications does not opt you out of communications related to your account or transactions.
Job Application Materials. To submit job application materials, you may complete the application form available on our Site. If you submit job application materials, we may use the contents to evaluate your qualifications and respond to you. Submission of materials does not require us to review them or consider you for employment.
Sweepstakes & Contests. We may offer sweepstakes or contests. To participate you must submit certain data, which may include your name, email, organization name and type, phone number, physical address, and other Personal Data. Data collected via sweepstakes and contests will be (i) used to contact you with promotional and related communications, (ii) shared with third-party vendors, and (iii) subject to additional terms as set forth in the applicable rules provided to you at such time, which may override any or all of the provisions in this Policy.
User-Generated Content. You are responsible for any comments, data, text, images, video, audio, and other content and material you create, post, transmit, upload, publish, distribute, broadcast, submit, or otherwise provide via the Site, including by commenting on blog posts or on our social media platforms (collectively, “User-Generated Content”). User-Generated Content is posted at your own risk. We cannot guarantee User-Generated Content will not be viewed by unauthorized persons. You understand that, even after removal, copies of User-Generated Content may remain viewable in cached and archived pages and may have been copied or stored by internet archives and other users. We may make User-Generated Content available to other users of the Site (as applicable and at our sole discretion) and will use and disclose User-Generated Content for the purpose for which it was provided.
Franchise Inquiries. If you fill out an inquiry form on the Site with respect to Fun Brands franchising opportunities, you will need to submit your name, address, phone number, email address, financial data (e.g, cash available for investment and estimated net worth) and other data.
Data Automatically Collected
IP Addresses, Cookies & Similar Tracking Technologies. When you use the Site, we and our Site vendors use various technologies such as cookies (i.e., small pieces of data stored on your device’s hard drive by your browser), web beacons, pixel tags, and other similar technologies to automatically collect internet protocol addresses assigned to the computers and other devices you use, your internet service provider, device ID number, approximate geographic location, browser type, Site pages visited, websites you access before and after visiting the Site, and data related to how and when you use the Site (e.g., date and time stamps, clickstream data, and data about search terms and websites that direct you to the Site). We may combine this Collected Data with other Collected Data (including Personal Data) and data obtained from third parties.
The Site may use session, persistent, and flash cookies (local stored objects) to collect and store data about your preferences and navigation to, from, and on our Site. Session cookies are used to complete transactions and for other purposes such as counting visits to certain webpages. Session cookies are eliminated when you exit your browser. Persistent cookies may be stored on your computer by your browser. When you log in, persistent cookies tell us whether you’ve visited the Site before or if you’re a new visitor.
Flash cookies are different from browser cookies because of the amounts and types of data collected and the manner the data is stored. Cookie management tools provided by your browser will not remove and cannot be used to manage Flash cookies. Most browsers automatically accept cookies. You can disable this function, but please be aware that if you disable or remove these technologies, some parts of the Site may not work and that when you revisit the Site your ability to limit browser-based tracking technologies is subject to your browser settings and limitations. Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note, however, there is no consensus among industry participants as to what “Do Not Track” means in this context. Like many online services, Fun Brands currently does not alter our practices when we receives a “Do Not Track” signal from a visitor’s browser. Fun Brands is not responsible for the completeness or accuracy of this third party information.
Due to the automatic collection of data using cookies, we do not honor “do not track” requests, except as required by law.
Location Information. Beyond approximate geographic location data, we may, with your consent, access more specific location data to enhance your user experience and increase the usefulness of the Site. This includes both geographical location data that you input using the Site (e.g., when you enter your zip code, city, or physical address) and, as applicable, geographical location data collected by device-based location services (including GPS data). You may grant the Site access to your location when prompted or through your device’s location services settings.
Analytics. We may occasionally enable and implement various analytics tools, such as Google Analytics, which is an analytics tool provided by Google to collect and process Collected Data consisting of certain telematics about your use of the Site. Google sets and reads cookies to collect such Collected Data and your web browser will automatically send such Collected Data to Google. Google uses this data to provide us with reports that we use to improve the Site’s structure and content.

Online Behavioral Advertising. We may occasionally use advertising networks and services provided by third-party vendors. These services collect certain data related to your interactions with the Site and other websites across the internet and use such data to target personal content and advertisements for goods and services. The data collected may be associated with your Personal Data. The targeted content and advertisements may appear on the Site and on other websites and may be sent to you via email or SMS messages. Advertising networks often gather data about consumers who view advertisements to make inferences about a consumer’s interests and preferences, which enables their computers to deliver advertisements directly targeted to the consumer’s specific interests. This practice is often referred to as “online behavioral advertising.”
To change your preferences with respect to certain online ads and to obtain more data about third-party ad networks and online behavioral advertising, please visit the National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Please remember that changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may still see our ads from time to time.
Social Media. We are active on social media, including Facebook, Instagram, Twitter, YouTube, FourSquare, Yelp, and Pinterest (“Social Media”). You have the opportunity to comment on Social Media regarding Fun Brands and the programs, products and services we offer. Any content you post on Social Media will be treated as non-confidential information. We may post (or re-post) on the Site and our Social Media pages any comments or content that you post on our Social Media pages.
The Site allows you to connect to and share information with various Social Media. These features may require us to implement cookies, plug-ins, and APIs provided by such Social Media to facilitate those communications and features.
Anything you post on Social Media is public information. YOU AGREE TO HOLD FUN BRANDS AND ITS AFFILIATES HARMLESS AND WITHOUT LIABILITY FOR THE RESULTS OF ANY AND ALL CONTENT YOU POST ON FUN BRANDS’S SOCIAL MEDIA.
Your use of Social Media and the collection, use, and sharing of Personal Data is governed by the privacy policies and terms of the third parties that own and operate those sites and NOT by this Policy. We encourage you to review the privacy policies of Social Media providers.
The Site may also use the advertising services and networks offered by Social Media to deliver advertising content. Use of these services requires Social Media to implement cookies or pixel tags to deliver ads to you while you are accessing the Site.
Data from Other Sources. We obtain data about individuals from various third-party companies and public sources and we may combine this data with Personal Data or other Collected Data. This enhances our existing data about our users and customers (e.g., adding address data) and improves our ability to contact you and our marketing’s relevancy.
SMS Messaging. Any data obtained from you in connection with SMS messaging service may include your mobile phone number, your carrier’s name, and the date time and content of your messages and other information you provide to us. We may use this information to contact you and provide services you request from us. Message and data rates may apply for any messages sent to you from us and to us from you. The number of messages per month you will receive will vary based on your purchases and activity instore and online. You should expect to receive 2-5 messages per month. If you have any questions about your text or data plan, it is best to contact your wireless provider.
How We Use & Share Collected Data
Beyond the uses and sharing described above, Fun Brands and its vendors may use and disclose Collected Data as described below. We do not sell or rent Collected Data except as stated in this Policy and as permitted by applicable law.
Vendors & Consultants. We may share your Personal Data and other Collected Data with our affiliates, third-party vendors, service providers, suppliers, consultants, agents, distributors, sales representatives, resellers, and other partners (including Site management and hosting, payment processing, marketing and public relations, and email services and SMS services) that provide data processing services to us (e.g., to support the delivery of, provide functionality on, or help to enhance the security of the Site or our services or products) or who otherwise process Personal Data for purposes described in this Policy or communicated to you when we collect Collected Data. Our vendors are authorized to and may use and disclose Collected Data as necessary to provide the applicable services to us and as provided by their own privacy policies.
Franchisees. Each individual Fun Brands location may be owned by a franchisee, which is a separate legal entity from us. As a result, Collected Data may be shared with those individual franchisee entities so they can provide products and services to you, send you communications, and for analytical, reporting, and other legitimate business purposes. In addition, information that you share with any individual location or franchisee may be submitted back to us and maintained by us and may be shared with other franchisees. We have no responsibility or liability for the acts or omissions of any third party or any data privacy or security measures of any third party, including any third-party franchisee that may receive access to your data. This Policy only sets forth the practices of Fun Brands.
Aggregated Data. We may use Collected Data (including Personal Data) to create anonymous aggregate data. We may use and share such aggregate data with our affiliates, vendors, and other third parties to: (1) analyze, develop, and improve the content, materials, products, and services that we make available, (2) inform business strategies, (3) understand the Site’s demographics and user preferences, (4) customize promotional emails and users’ Site experience, and (5) for other lawful purposes.
Security & Protection of Rights. We may use Collected Data and share it with third parties if we believe it is necessary to operate the Site or to protect our rights or the rights of others, including disclosing data necessary to identify, contact, or bring legal action if our contracts, terms, or policies are violated or if required by law.
Business Transactions. All Collected Data is exclusively our property. If we undergo a change or contemplated change in control, acquisition, merger, reorganization, or asset sale, all Collected Data may be transferred, sold, shared, or otherwise disclosed to any potential and actual successors, which will be bound by this Policy as it applies to Collected Data.
With Your Consent. With your consent, we may use or share Collected Data in ways not specifically described in this Policy.
Data We Do Not Intend to Collect
1. Special Categories of Personal Data. “Special Data” is any data that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or that involves genetic or biometric data or data concerning health or sexual orientation. We do not intend to collect any Special Data from you. Please refrain from providing Special Data to us.
2. Children. We are committed to protecting children’s privacy. The Site is not directed at children under 13 years of age. We do not knowingly collect, use, or share data from children under 13. If a parent or legal guardian learns their child provided us with Personal Data without his or her consent, please contact us.
We use commercially reasonable technical and organizational measures to help secure all Collected Data against loss, misuse, and alteration. While we cannot guarantee it, we use industry-standard protections to help safeguard against such occurrences. If a breach of our systems occurs, we will notify you of the breach only if and as required under applicable law.
YOU UNDERSTAND THAT NO DATA TRANSMISSION OVER THE INTERNET OR A MOBILE DEVICE CAN BE GUARANTEED TO BE 100% SECURE. WHILE WE STRIVE TO PROTECT YOUR PERSONAL DATA, WE DO NOT GUARANTEE THE SECURITY OF PERSONAL DATA AND YOU PROVIDE PERSONAL DATA AT YOUR OWN RISK.
Access from Outside the United States
If you access the Site from outside the United States, please be aware that Collected Data may be transferred to, stored in, and processed in the United States. U.S. data protection and related laws may not be as comprehensive as those from where you access the Site.
Your California Privacy Rights
We do not share personal information as defined by California Civil Code Section 1798.83 (“Shine the Light law”) with third parties for their direct marketing purposes without either obtaining your consent or giving you the ability to opt-out. To opt-out of future sharing with third parties for their direct marking purposes, check here. If you are a California resident, you may request information about our compliance with the Shine the Light law by contacting us here or by sending a letter to the address noted in the Contact Us section below. Any such request must include “California Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this email address or mail address. Parents of California minors should see “Children’s Privacy” regarding removal of certain content they have posted.
